General Terms and Conditions

§1 Validity towards consumers and definitions of terms
(1) The following General Terms and Conditions apply to all contracts concluded via our Internet shop athttps://sonaura.com between us, the

and the customer in the version valid at the time the contract is concluded. Deviating general terms and conditions of the customer shall not be recognised unless we expressly agree to their validity in writing.

The products offered in our online shop are only intended for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession (§ 13 BGB).

§2 Conclusion of a contract, storage of the contract text
(1) The presentation and advertising of the goods in our Internet shop do not constitute a legally binding contractual offer on our part, but are only a non-binding invitation to the customer to order goods.

(2) By clicking on the ‘Buy’ button in the last step of the ordering process, the customer submits a binding offer to conclude a contract for the purchase or booking of the goods and/or services displayed in the order overview (offer).

(3) The order is placed in the following steps:

  • Selection of the desired goods and colour
  • Adding the goods to the shopping basket by clicking the ‘Add to basket’ button
  • Select further items or view the shopping basket
  • Checking the details in the shopping basket and making changes if necessary
  • Click on the ‘Checkout’ button
  • Log in to the online shop or express checkout of the payment service ‘PayPal’ (prior registration required in each case) and enter the login details (e-mail address and password) or enter the contact and delivery address and, if applicable, enter a voucher or discount code
  • Click on the ‘Continue to dispatch’ button
  • Check or correct the data entered once again
  • Select the shipping method
  • Click on the ‘Continue to payment’ button
  • Select the payment method and enter the required information
  • Binding dispatch of the order by clicking on the ‘Buy’ button or, if the ‘PayPal’ payment service is selected, by clicking on the ‘Pay now’ button
  • After checking their details and before submitting the binding order, the customer can return to the website on which the customer's details are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the ‘Back’ button in the Internet browser they are using or by clicking the ‘Change’ button next to the contact details and shipping details.


(4) We confirm receipt of the order immediately by means of an automatically generated e-mail (‘confirmation of receipt’). A valid contract is only concluded with the dispatch confirmation by e-mail (acceptance).

(5) We will send the customer the text of the contract (details of the order), our GTC, including the voucher and discount conditions and the cancellation policy, if applicable, by email. The customer can also view the GTC at any time at http://www.sonaura.com/agb. For security reasons, the order data is no longer accessible via the website.

(6) The privacy policy can be found at https://sonaura.de/pages/data.

(7) The contract is concluded in German in Germany, in the EU and the USA currently still in English.

§3 Prices, shipping costs, payment
(1) The prices quoted include statutory VAT and other price components. Any shipping costs are added, unless otherwise specified below. The shipping costs are stated in our prices in our online shop. The price including VAT and any shipping costs incurred is also displayed in the order form before the customer submits the order.

(2) The customer has the option of paying via all payment methods offered by Shopify Payments and Paypal.

§4 Delivery
(1) Orders are processed within 2 working days and then dispatched. Delivery within Germany takes 1 to 2 additional working days. Delivery within Europe takes 3 to 6 working days and delivery to the USA or Canada takes 6 to 12 working days.

(2) The risk of accidental loss and accidental deterioration of the item sold shall not pass to the customer until the item is handed over to the customer or in the event of default of acceptance by the customer, even in the case of sale by despatch, if the customer is a consumer.

(3) If there are delivery problems when the order is placed or if a product is no longer available when the order is placed, we shall inform the customer of this immediately and refrain from accepting the order. We shall immediately refund to the customer all amounts that he may have already paid to us for the unavailable products.

§5 Retention of title and prohibition of resale
(1) We reserve title to the goods until the purchase price has been paid in full.

(2) The customer warrants to use the products exclusively for private purposes. Any commercial or industrial resale of the purchased products is prohibited.

§8 Right of cancellation
(1) If the customer is a consumer, he is entitled to a statutory right of cancellation in accordance with the following cancellation policy.

You have the right to cancel this contract within fourteen (14) days without giving any reason. The cancellation period is fourteen (14) days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample cancellation form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of cancellation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.

You shall bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

The right of cancellation does not apply to contracts for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the buyer is decisive or which are clearly tailored to the personal needs of the buyer as well as for contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

§9 Voluntary right of return up to 30 days after receipt of goods
(1) Notwithstanding the statutory right of cancellation, the customer is granted a voluntary right of return of 30 days from receipt of the goods in accordance with the following provisions. With this right of return, the customer can also withdraw from the contract after expiry of the 14-day cancellation period (see cancellation policy above) without giving reasons by returning the goods to us within 30 days of receipt (period begins on the day after receipt of the goods).

(2) The voluntary right of return only applies to new and unworn goods. Items that have already been worn or washed cannot be returned. The items must be returned in their complete original packaging. Any original label must be present. If these requirements are not met, the return may be refused.

(3) The voluntary right of return does not apply to the purchase of gift vouchers or to goods for which the statutory right of cancellation is excluded (see cancellation policy above).

(4) The customer shall bear the cost of returning the goods. The delivery note included in the consignment is not a return label. The completed delivery note must be enclosed with the return shipment for processing. If a delivery note is missing, the name, order number and, if applicable, the reason for the return must be stated on a piece of paper.

(5) Different orders can be sent together, whereby the jewellery in the corresponding packaging and all delivery notes or pieces of paper specified in paragraph (4) must be enclosed with the return.

(6) No separate confirmation of receipt will be sent upon receipt of the returned goods. As soon as the return has been processed, the customer will receive a notification. The processing time is usually 10 days and may be extended in the case of larger sales campaigns.

(7) Refunds will be made to the account used for payment. If payment is made by PayPal, credit card or Apple Pay, the refund will be made to the associated PayPal or credit card account. When purchasing using a gift voucher, a digital gift voucher will be issued for the corresponding amount.

(8) Until the expiry of the period for the statutory right of cancellation, only the statutory conditions listed there apply. The voluntary right of return does not limit the statutory warranty rights.

§10 Warranty
The statutory warranty regulations apply, unless otherwise specified below.

§11 Limitation of liability
(1) We shall be liable to the customer in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of futile expenses.

(2) In other cases, we shall only be liable - unless otherwise regulated in paragraph 3 - in the event of a breach of a contractual obligation, the fulfilment of which is essential for the proper execution of the contract and on the observance of which you as the customer may regularly rely (so-called cardinal obligation), limited to compensation for foreseeable and typical damage. In all other cases, our liability is excluded subject to the provision in paragraph 3.

(3) Our liability for damages resulting from injury to life, limb or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

§12 Customer service

§13 Final provisions
(1) The law of the Federal Republic of Germany shall apply to contracts between us and the customer to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular of the country in which the customer as a consumer has his habitual residence, remain unaffected.

(2) Should individual provisions of these General Terms and Conditions be invalid, void or incomplete, this shall not affect the validity of the remaining provisions. The parties shall replace the ineffective or void provision with such a provision - if necessary in the appropriate form - or fill the gap in the contract with such a provision with which the economic purpose pursued by you can be achieved as closely as possible. If the ineffectiveness or invalidity of a provision is based on a measure of performance or time (deadline or date), a legally permissible measure shall replace the ineffective or invalid performance or time provision.
